Conditions for patenting of invention and protection:
- A patent must be new i.e. it must not be done anywhere in the world
- A patent must involve an inventive step i.e. the invention must not be obvious to a person ordinarily skilled in that technical field.
- A patent must be capable of industrial application i.e. the invention must be capable of being made or used in an industry.
An applicant must be an inventor; an assignee, or a legal representative.
